By accessing the software and subscription services provided by SFR Analytics Inc. ("SFR Analytics"), you, the end-user ("Client"), agree to comply with the terms and conditions set forth herein, as well as any additional terms agreed upon between SFR Analytics and the Client under any previously executed Student Purchase Agreement ("Agreement").

Upon subscribing to SFR Analytics, you become a Client of SFR Analytics. The services offered by SFR Analytics are subject to your acceptance of these Terms of Use without modification or reservation.

Your agreement with SFR Analytics and/or use of its services signifies your unconditional acceptance of these Terms of Use. SFR Analytics reserves the right to modify these Terms at any time without prior notice by posting the changes on its website.

Clients acknowledge that billing will be processed as a monthly subscription fee, as detailed during the signup process, including any upgrades, enhancements, or fee-based services agreed to by the Client within the Service or on the order page on SFR Analytics' website or that of its affiliates. Subscriptions can be cancelled at any time by selecting the “Cancel My Account” option within your account settings. To cancel, log into your account, navigate to “Settings,” select the “Account Activity” tab, and follow the prompts.

Should the primary payment method fail for any reason, the Client authorizes SFR Analytics to charge any other payment methods on file to cover the outstanding balance(s).

SFR Analytics grants the Client a non-exclusive, non-transferable license to access and use the provided data, information, and services during the subscription term, subject to the following License Restrictions:

License Restrictions

The Client agrees that the data, information, and services provided will be used solely by the Client, and not by any third parties, unless the subscription specifically allows for such use. SFR Analytics will monitor search volumes and usage patterns to prevent abuse, data duplication, "data mining", and excessive or unconventional usage. Any such activities, as determined at the sole discretion of SFR Analytics, may lead to immediate termination of the Client's account. The Client also agrees not to:

• Use the services for anything other than personal use, i.e., no commercial purposes.

• Reproduce, reformat, distribute, or disseminate any service or product to third parties.

• Use the services for marketing, telemarketing, Internet, or real estate valuation models.

• Combine or include services with any other product or service.

• Extract or use any data element for any purpose.

• Engage in real estate appraisal, credit evaluation, risk evaluation, insurance product marketing, debt collection, or the marketing/sale of legal goods/services, unless the subscription allows for such use.

Team Accounts

Team Accounts are intended for use by designated Team Members who are directly associated with the business holding the Primary Account. Each Team Member must accept these Terms of Use & End User License Agreement prior to access. Team Members can be employees or direct consultants/contractors of the Primary Account Holder and must use the Service for the business needs of the Primary Account Holder exclusively. The exchange of money or value for access to SFR Analytics' services by a Team Member is strictly forbidden and will result in immediate account termination and possible legal repercussions.

Acceptable Use Policy

• Lawful Purposes: You are committed to using the services strictly for legal activities, avoiding any actions that could be considered deceptive, fraudulent, or illegal.

• No Nuisance: The services should not be used to cause annoyance, inconvenience, or nuisance to others.

• Non-commercial Use: The services are for your personal, non-commercial use.

• Respect for Rights: You must not violate the rights of others, including privacy and publicity rights.

• No Unauthorized Copying or Distribution: You agree not to copy or distribute content from the services without authorization.

• Personal Use of Content: While you can use content from the services for personal, non-commercial purposes, you cannot compile or create collections or directories from such content without permission.

• Accuracy of Information: The information you provide to the service or communicate with the service provider must be accurate and truthful.

• No Service Abuse: You agree not to use the services in a way that could harm, disable, overburden, or impair the service or connected networks.

• No Unauthorized Access: Attempting to gain unauthorized access to any part of the services, accounts, or connected networks is prohibited.

• Restricted Automated Access: The use of automated processes to access or scrape the services without permission is not allowed.

• Reporting Obligations: You are obligated to report any found errors, bugs, unauthorized access methods, or intellectual property infringements.

• No Impersonation: Creating fake profiles or impersonating others is strictly prohibited.

• Compliance with Electronic Advertising Laws: You must adhere to laws and regulations governing electronic advertising.

• Restriction on Large Files: You agree not to upload content that is excessively large, as determined by the service provider.

Privacy and Security

The Privacy Policy is an integral part of the agreement, detailing how personal data is collected, used, and protected. By agreeing to the Acceptable Use Policy, you also agree to the Privacy Policy.

Subscription Terms and Termination

Subscriptions auto-renew monthly unless canceled. You are responsible for all fees until the end of the current billing cycle upon termination.

Termination Process

You can terminate your subscription through specific actions outlined, such as using a cancellation button within the account settings or sending a written request.

Proprietary Rights and Consequences of Non-Compliance

The service and its content are protected by intellectual property laws. Your access is limited to personal use, respecting these rights. Violating these terms may lead to termination of your access, possibly with a pro-rata refund, depending on the violation's severity.

Client Services and Promotions

You must ensure all information provided to the service is accurate and up-to-date. The service provider reserves the right to terminate or suspend access if provided information is found inaccurate or misleading. Promotional opportunities may be offered selectively, based on eligibility criteria set by the service provider.

DISCLAIMERS AND LIMITATIONS

SFR Analytics attempts to ensure that the information contained in its service is accurate and reliable; however, errors sometimes occur. SFR Analytics does not guarantee the accuracy of the information contained in this service and instructs you to independently verify the accuracy of the information provided. THE WEBSITES AND THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES ASSOCIATED WITH THEM ARE PROVIDED "AS IS." SFR ANALYTICS, ITS SUPPLIERS, PROFESSIONAL SERVICE PROVIDERS, THIRD-PARTY CONTENT PROVIDERS, AND OTHER SERVICE PROVIDERS DISCLAIM ANY WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED. SFR ANALYTICS AND/OR ITS SUPPLIERS AND PROVIDERS, ARE NOT LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OR OTHER INJURY ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF SFR ANALYTICS'S SERVICE.

INDEMNITY

As a condition precedent to the use of the SFR Analytics service, the Client agrees to defend and indemnify SFR Analytics, Inc. and its employees, agents, and/or Service Providers from and against any liabilities, expenses (including attorneys' fees) and damages arising out of claims resulting from Client's use of SFR Analytics's service.

Choice of Law and Jurisdiction

These Terms of Use shall be governed by the laws of the State of California. All actions brought hereunder shall be brought in the state or federal courts located in and serving the State of California. Client consents to jurisdiction in the state of California.

MISCELLANEOUS TERMS

These Terms of Use may not be modified except by a writing signed by both parties. A party's failure to enforce strict performance of any provision will not constitute a waiver of its right to subsequently enforce such a provision. SFR Analytics reserves all rights not expressly granted in this license agreement. If any provision of this Agreement is found to be invalid, the invalidity of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect.

CONSENT

I have carefully read and considered all provisions of these Terms of Use and agree that all of the terms set forth are fair and reasonable. I acknowledge and warrant that I unconditionally consent to all of the terms of this Terms of Use agreement.

BY INSTALLING THE SOFTWARE AND/OR ACCESSING THE WEBSITE OR SERVICE, YOU (EITHER AN INDIVIDUAL OR A SINGLE ENTITY) CONSENT TO BE BOUND BY AND BECOME A PARTY TO THE AGREEMENT CONSTITUTED BY THESE TERMS OF USE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS OF USE, DO NOT INSTALL THE SFR ANALYTICS SOFTWARE AND/OR ACCESS THE WEBSITE OR SERVICE.
